Candle Hire Terms and Conditions
Effective Date: 01 November 2025
These Terms & Conditions (“Agreement”) govern the hire of candle styling services and related items (“Hire Items”) provided by Loved by Lucy xo Perth (“the Company”) to the Client (“the Hirer”). By paying the deposit and confirming a booking, the Hirer acknowledges and agrees to the following:
Booking and Payment
A minimum deposit of 20% of the invoice total (“Deposit”) is required to secure the booking. Event dates will not be held until the Deposit has been received in cleared funds.
Where the event date falls within 6 weeks of the invoice date, full payment of the invoice is required at the time of booking.
The balance of the invoice is due no later than 30 days prior to the event date, unless otherwise agreed in writing.
Deposits and payments are strictly non-refundable and non-transferable, except as set out under Clause 5 (Force Majeure).
Inclusions
All quotes provided by the Company are inclusive of delivery, setup, and pack down of Hire Items for the confirmed event.
Labour and delivery fees are quoted per booking and are calculated based on the total number of candles hired and the specific event venue.
Hire Items
The size and style of Hire Items may vary from time to time. Quantities supplied may include assorted sizes, subject to availability at the time of the event.
Hire Items remain at all times the sole property of the Company. The Hirer acquires no ownership rights in the Hire Items.
Dry hire of Hire Items is not offered. All Hire Items are to be delivered, installed, and removed by the Company’s staff only.
Cancellations and Postponements
The Deposit is non-refundable under any circumstances, including but not limited to cancellation, postponement, or change of mind.
In the event of cancellation:
(a) where notice is provided more than 6 months prior to the event date, all payments made excluding the Deposit will be refunded;
(b) where notice is provided within 12 weeks of the event date, the Hirer will remain liable for 75% of the total invoice value, less any payments already received;
(c) where notice is provided within 30 days of the event date, the Hirer will remain liable for 100% of the total invoice value.Postponements may be permitted at the sole discretion of the Company and are subject to availability. Where a postponement cannot be accommodated, the booking will be treated as a cancellation in accordance with Clause 4.ii.
Force Majeure
Neither party shall be liable for failure or delay in performance caused by circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, fire, flood, pandemic, government restrictions, industrial action, or other force majeure events.
In such circumstances, the Company shall use reasonable endeavours to reschedule the booking. Deposits remain strictly non-refundable but will be applied to the rescheduled booking date.
Liability for Damage and Loss
The Hirer is liable for any damage to, or loss of, Hire Items that occurs between delivery and collection by the Company.
Broken, damaged, or missing sand candles will be charged at a replacement fee of $50 per candle. Breakage of any other Hire Items will be invoiced accordingly based on replacement value and cost.
Where linen items are hired, the Hirer is liable for any damage, staining, or additional cleaning required, as reasonably determined by the Company.
The Hirer indemnifies the Company against all claims, losses, damages, or expenses arising out of the Hirer’s use of the Hire Items, except to the extent caused by the Company’s negligence.
The Company accepts no responsibility for, and the Hirer liable for, any damage to the venue property, furniture, plinths, or surfaces (including but not limited to wax residue, heat marks, or staining) resulting from the use of Hire Items, unless such damage is directly caused by the Company’s negligence during installation or pack down.
Exclusivity of Candle Supply (Where Applicable)
Where the Company is engaged to provide full candle hire and styling for an event, the Hirer agrees that the Company shall be the exclusive provider of all sand candles for the event.
The Hirer shall not engage or permit any third party to supply additional candles without the Company’s prior written consent.
This exclusivity requirement is especially applicable where the Company is providing sand candles, as the overall styling outcome and presentation rely on consistency of candle type and placement.
This requirement will be confirmed in writing by the Company at the time of booking and does not apply to bookings where the Company has agreed to provide only partial candle styling in collaboration with other suppliers.
In cases where exclusivity applies and the Hirer introduces unapproved candles, the Company accepts no responsibility for styling consistency, safety, or outcomes, and reserves the right to withdraw services without refund.
General
These Terms & Conditions constitute the entire agreement between the Company and the Hirer and supersede all prior discussions, agreements, or understandings.
No amendment or variation of this Agreement shall be valid unless made in writing and signed by both parties.
This Agreement shall be governed by and construed in accordance with the laws of Western Australia, and the parties submit to the exclusive jurisdiction of the courts of this State.
Acknowledgement
By making payment of the Deposit and/or full hire invoice amount, the Hirer confirms they have read, understood, and agree to be bound by these Terms & Conditions.
